Pregnancy treatments and medical negligence - legal aspect in light of Bhartiy Nyaya Sanhita

Abstract: Under the new legal framework of the Bhartiya Nyaya Sanhita (BNS), which supersedes the Indian Penal Code (IPC), medical malpractice during pregnancy treatments raises serious ethical and legal questions. This research looks at Section 106 of the BNS, which makes healthcare providers legally liable for patients' injuries or deaths caused by their carelessness. The study sheds light on important pregnant women's rights, the function of medical ethics in avoiding carelessness, and the medico-legal consequences of subpar treatment. The study used a quantitative methodology and surveyed 384 people across India using a standardized questionnaire. The study evaluated the effect of BNS provisions on decreasing medical negligence using analysis of variance and regression in SPSS and Excel. According to the results, pregnant women do not know much about their legal rights, and the biggest problem is not their lack of education but rather the obstacles posed by institutions. The study highlights the significance of healthcare providers receiving legal education and the necessity for well-rounded legal systems that safeguard patient rights while avoiding defensive medicine. To lessen the occurrence of medical mistakes during pregnancy treatments, it is essential to improve healthcare responsibility, strengthen medico-legal education, and promote ethical medical practices.
