Law and society examining the social impact of India’s criminal law reforms

Abstract: The introduction of new criminal laws in India — the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA) — marks a significant departure from the colonial-era Indian Penal Code (IPC), Code of Criminal Procedure (CrPC), and Indian Evidence Act. This paper examines the social impact of these reforms, analyzing how they affect citizens, law enforcement, marginalized communities, and the broader relationship between law and society. By evaluating both the intended outcomes and unintended consequences of these reforms, the paper highlights key challenges and opportunities in aligning legal reform with social justice.
