The impact of commercialization on surrogacy in India: A critical analysis

Abstract: Surrogacy is a sensitive issue, particularly in light of renowned celebrities' use of the procedure. Although it may be utilised commercially, it is a godsend for couples who are unable to have a regular pregnancy. In December 2018, the Indian government passed a surrogacy bill that dramatically revised the previous laws. For example, it forbids commercial surrogacy and restricts foreigners' ability to apply for surrogacy in India. Organisations that arrange surrogacy for foreigners have experienced a significant blow as a result. This law was created in great part to address the discriminatory treatment of surrogate women. Their living conditions were poor, and they frequently did not get the financial support that the intended parents had donated to the institution.Commercial surrogacy is legal in several countries, such as the United States, Poland, Russia, and a number of others. Assisted reproductive technologies might cause issues for certain surrogate moms. The most common are ovarian hyper stimulation syndrome, psychological stress, and ectopic pregnancy. It is critical that we encourage same-sex couples, single parents, and even infertile women to adopt. In 2021, India established a new set of surrogacy legislation.
