Prisoners’ right with reference to article 21 under the Indian constitution: An overview

Abstract: Prisoner means an individual who lawfully committed to jail as a sentence for an offence or while pending trial. Every person is born with certain basic rights and that cannot be curtailed with a prisoner. However, while looking at the Indian perspective, it is clear that amongst various issues that have given birth to a concern at the national level, the issue of prisoners right is most noteworthy. It is not a common matter to hear the news about violation of various human rights of prisoners while undergoing imprisonment. Considering this background, this paper is going to present an overview about the constitutional position of prisoners’ right in India. More specifically, this paper is going to cover the analysis of prisoners’ right to life under Article 21 to the Constitution of India. How Article 21 applies to rights of prisoners; to what extent this right is getting realized; what sort of challenges are emerging/has emerged in this regard—these are certain aspects going to be covered in the succeeding portion of this research work.
