The legal basis for employment contracts and their conditions in Iraq and Lebanon

Abstract: The employment contract is a means of management in public sector departments in order to satisfy the needs of individuals by providing the necessary human resources to achieve this goal, through the use of individuals who possess the required scientific and technical qualifications. This contracting process, like other contracts, must be based on a sound legal basis in order to gain legal legitimacy and thus produce legal effects for both the administration and the contracting individual alike. Through this research, we review the most important laws, regulations and instructions that deal with the organization of employment contracts in public sector departments in Iraq and Lebanon, as well as explaining the conditions related to this contract that were drawn up by the laws and instructions in the Iraqi and Lebanese legislation. With reaching the most important results in this research, which is the absence of a unified legal organization that addresses employment contracting in both Iraq and Lebanon, with the recommendation to legislate a detailed law, independent or within the Civil Service Law, that organizes employment contracting in a sound manner and determines the legal conditions that contribute to the selection of contractors who benefit public sector departments.
