Analysis of agricultural land acquisition, effect and compensation for damage by state in Vietnam

Abstract: The late 20th century witnessed Vietnam's dramatic integration into the global market. This triggered a large-scale conversion of agricultural land for urban and industrial development, driving significant economic changes and social transformations. Examining the compensation theory within the context of Vietnamese agricultural land acquisition offers valuable insights into the socio-economic impacts of these land-use changes and the effectiveness of implemented compensation mechanisms. While existing literature highlights potential shortcomings in the provisions of the Land Law 2013, a critical emerging concern lies in the implementation gaps of this very policy. This paper aims to analyze the potential differences in compensation practices for state-acquired agricultural land before and after the introduction of the Land Law 2013. More importantly, it delves into a crucial question: should the focus be on amending the Land Law 2013 or streamlining the institutional structures responsible for implementing its current provisions?.
