Artificial intelligence in the creative domain: Navigating copyright challenges in India

Abstract: The rise of Artificial Intelligence (AI) has revolutionized numerous fields, including the realm of creativity, where AI-generated content challenges traditional notions of authorship and copyright. This paper delves into the role of AI in creative processes, examining the implications of AI-generated works on existing copyright laws in India. While AI enhances human potential, fosters creativity, and reduces the need for manual labor, it also raises critical questions about the ownership and protection of AI-generated content. Historically, creative works produced with the assistance of machines have relied heavily on human input, with humans recognized as the creators and owners. However, as AI evolves, it increasingly creates works autonomously, without human intervention, thus complicating the attribution of authorship and ownership. This paper explores these challenges, analyzing the current legal framework and its adequacy in addressing the emerging issues posed by AI in the field of creativity. It also discusses the potential need for new legal definitions and protections to ensure that AI-generated content is properly regulated and that the rights of all stakeholders are safeguarded. Thus, this paper attempts to discuss and analyze the role of AI in the field of creativity posing challenges on the current copyright law in India.
