Juvenile justice and human rights: Reforming India’s juvenile justice act

Abstract: India’s Juvenile Justice (Care and Protection of Children) Act, 2015 represents a significant milestone in the evolution of juvenile justice in the country. While the Act seeks to balance child protection with public safety, its provisions-particularly regarding juveniles in conflict with the law aged 16-18 involved in heinous offenses-have generated intense debate. This paper critically examines India’s juvenile justice framework in light of international human rights standards. It explores the evolution of juvenile justice laws in India, assesses the compliance of the current legal regime with global norms such as the United Nations Convention on the Rights of the Child (UNCRC), and analyzes ongoing legal, ethical, and procedural challenges. The paper argues for reforms aimed at restoring the primacy of rehabilitation over retribution, strengthening institutional capacities, ensuring procedural fairness, and harmonizing India’s juvenile justice system with its constitutional and international obligations.
